§ 3 Contract conclusion
With your order you make a legally binding offer to conclude a contract with STM GbR. The purchase contract is concluded when STM GbR accepts your offer by shipping the goods. The transmission of account data by e-mail for the purpose of prepayment does not constitute a declaration of acceptance on the part of STM GbR.

§ 4 Cancellation policy

You have the right to cancel this contract within fourteen days without giving a reason.

Consequences of withdrawal
If you withdraw from this contract, we will owe you all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us) immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. § 6 Non-existence of the right of withdrawal
The right of withdrawal does not exist:
1. if you are not a consumer within the meaning of § 13 BGB.
§ 7 Delivery, subsequent delivery
Unless otherwise agreed, delivery will be made to the delivery address you specified. Information about the delivery period is non-binding, unless the delivery date has been promised as an exception.
In individual cases, STM GbR offers you that a product that is initially not available will be sent later if it is available (subsequent delivery). You pay no additional shipping costs or cash on delivery fees for the subsequent delivery.
§ 8 Exchange
STM GbR is not obliged to exchange flawless goods. STM GbR usually fulfills your exchange request as far as this is possible. STM GbR can charge additional shipping costs for new shipments due to exchanges. Your right of withdrawal (cf. § 4) is in no way limited or excluded by this regulation.
§ 9 Payment
With STM GbR you can pay throughout Germany by PayPal and in advance. STM GbR reserves the right to exclude or exclude the payment methods invoice and direct debit for existing customers. for individual orders.
When paying in advance, you pay in advance directly to the account of STM GbR. It should be noted that in the case of advance payments (particularly from abroad) Bank charges are to be borne by you. The full invoice amount must be received by STM GbR.

The purchase price is due immediately upon conclusion of the contract.
§ 11 Set-off, right of retention
You only have the right to set-off if your counterclaims have been legally established or recognized by STM GbR. You are only authorized to exercise a right of retention insofar as your counterclaim is based on the same contractual relationship.
§ 12 Retention of title
The goods remain the property of STM GbR until full payment.
§ 13 Warranty for defects and liability
The statutory warranty provisions apply. The warranty period is 2 years and begins when the goods are handed over. Your warranty claims are initially limited to supplementary performance (elimination of defects or replacement delivery). The place of supplementary performance is the headquarters of STM GbR or alternatively the branch offices. This applies in particular to kayaks and SUP hardboards.
Unless otherwise stated below, further claims - regardless of the legal grounds - are excluded. STM GbR is therefore not liable for damage that has not occurred to the delivery item itself; in particular, STM GbR is not liable for lost profits or other financial losses. Insofar as the liability of STM GbR is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.
The above limitation of liability does not apply if the cause of the damage is based on intent or gross negligence or there is injury to life, body or health. Furthermore, the limitation of liability does not apply if you assert claims from Sections 1 and 4 of the Product Liability Act. Furthermore, the limitation of liability does not apply in the event of a breach of a material contractual obligation.
§ 14 Data protection and data security
The personal data you enter when placing the order, e.g. B Sort code, bank account number, name and address are encrypted and thus protected against unauthorized access during transmission over the Internet. STM GbR uses a secure transmission method - the so-called "Secure Socket Layer" (SSL) transmission.
By placing the order, you agree that STM GbR can store and process your personal data contained in the order and use it within the framework of the customer relationship.
§ 15 Applicable Law
The entire legal relationship between you and STM GbR is based on German law. UN Sales Convention (CISG) does not apply.
